Environmental authority applications - Level 1 (Chapter 5A) activities

A reference to a level 1 (chapter 5A) activity is a reference to an environmental authority that was required under the former Environmental Protection Act 1994. Petroleum (including coal seam gas and conventional oil and gas), geothermal and greenhouse gas storage activities were Chapter 5A activities and an environmental authority was required to be issued before these activities could be carried out.

Applications for level 1 (chapter 5A) activities made prior to 1 April 2013 under the former Environmental Protection Act 1994 may have included:

Requirements for public notifications and submissions

Under the former Environmental Protection Act 1994, it was a requirement that all level 1 Chapter 5A applications for an environmental authority and certain amendment applications for level 1 Chapter 5A environmental authorities, undergo a process of public notification.

For applications made under the former Environmental Protection Act 1994 where public notification is required, the applicant must, within 2 business days after the application date (and 15 business days for amendment applications), publish a notice in a paper circulating generally in the area where the relevant Chapter 5A activities are proposed.

A subscription email service also provides updates on the latest public notifications and environmental authorities. To subscribe, send an email to public.register@ehp.qld.gov.au.

Anyone may make a submission to the administering authority about an application. The submission must be in the approved form and be received by the administering authority by the end date of the submission period specified in the public notice. To be considered properly made, a submission must:

  • be written
  • be signed by or for each person (signatory) who made the submission
  • state the name and address of each signatory
  • be made to the authority
  • be received on or before the last day of the submission period.

When assessing and deciding an application, the administering authority gives due consideration to all submissions received. All submissions should be sent to the Energy Assessments Unit, Department of Environment and Heritage Protection, GPO Box 2454, Brisbane, QLD, 4000.

It is important to note that only people who provide submissions to public notifications may appeal to the Land Court.
